David Cassidy divorce turns ugly
David Cassidy's divorce has taken a sinister twist as his estranged wife has asked a Florida judge to force him to immediately sell their joint property.
According to reports the American singer, songwriter and actor is allegedly still attending rehabilitation session orders by the court. This hasn't however stopped his estranged wife, Sue Cassidy, from asking a judge in Florida to force him to sell their joint property, immediately.
In February this year Mrs Cassidy filed for a divorce after the singer was arrested for drunk driving, for the third time.
Petition to Partition
Radar Online learned that Sue Cassidy had filed legal documents which asked the court to force the troubled singer to sell their jointly-owned property. Mrs Cassidy apparently filed a Petition for Partition.
A Petition for Partition is the name given to the proceeding when there are co or multiple owners of property and a disagreement arises about the fate of the house. A Petition to Partition allows at least one owner of the property to petition the court to divide the real estate and force a sale.
When the process of a Petition to Partition has began, a notice is issued by the court to all owners of the property and anyone else involved with the real estate, the mortgage holder for example.
A Petition to Partition typically occurs when a family or joint owners of a property cannot agree on the terms of the sale of the house. In many cases, the family or co-owners are unable to communicate and a Petition to Partition is necessary to act on behalf of uncooperative heirs.
As BW Law states:
"A Petition to Partition proceeding should be viewed as a last resort when there is basically no cooperation among family members. All parties must understand that there will be significantly more expense and time delay, and their property may in fact be sold to an unwanted buyer at a lower than anticipated rate”.
In the case of the Cassidy's, Sue Cassidy filed for a Petition for Partition since herself and David could not come to an agreement together.
The property in question is a 7,000 square foot home in Florida, which comprises of five bedrooms, seven bathrooms, a chef's kitchen and a private balcony.
Talking about her decision to file for divorce, Sue Cassidy told the Daily Mail:
"I'm glad David is getting the help he needs and I am confident he will come back better and stronger than ever”.
"I am truly heartbroken that our marriage is ending” added David Cassidy's estranged wife.
