According to the filing, the reason given for the divorce was ‘irreconcilable differences’. The paperwork was reportedly filed by Witherspoon in Nashville, in the Circuit Court of Davidson County not far from the couple’s home.

 

Witherspoon and top talent agent Toth have been married for nearly 12 years. In fact, the couple would have celebrated their 12th wedding anniversary on the weekend just after they revealed that they were separating. The pair married in California in March 2011, and have one child – Tennessee James – together.

 

The marriage was Witherspoon’s second, after she separated from fellow actor Ryan Philippe in 2006 after a 7-year marriage and two children – Ava and Deacon, now aged 23 and 19 respectively.

 

On 24th March 2023, Witherspoon and Toth released a joint statement on the actor’s Instagram account which read:

 

“We have some personal news to share… It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness, and mutual respect for everything we have created together.”

 

“Our biggest priority is our son and our entire family as we navigate this next chapter,”

 

“These matters are never easy and are extremely personal. We truly appreciate everyone’s respect for our family’s privacy at this time.”

 

In the divorce filing, the Legally Blonde star asked the court to name both her and Toth as joint custodians of their 10-year-old son.

 

People has reported that the decision to split is an amicable one, according to a source close to the couple. The source also said that the pair are committed to co-parenting together.

 

The prenup

 

In the court documents filed in Nashville, it was confirmed that Witherspoon and Toth do have a prenuptial agreement in place. However, the details of the agreement have not been publicly revealed. All the legal filing says is that the prenup will be submitted to the judge and that it will provide "adequate and sufficient provisions"  for the couple’s assets and debts.

 

According to Forbes, the 47-year-old actor is worth an estimated $116 million, while the 52-year-old talent agent has a net worth of around $20 million (as reported by Hello Magazine).

 

The pair have numerous shared assets, including family homes and profits from property they’ve sold together during their marriage. This includes a Los Angeles mansion they bought for $15.9 million in 2020. After renovation, it was sold for $21.5 million in 2022.
